Definitions of Terms:

Definitions: In this agreement the terms have the following meaning:

The Company: Protect My Work, ProtectMyWork.com or "www.ProtectMyWork.com" is the trading name of Protect My Work Limited, a company registered in England and Wales no 4358873.

The User, Member or Subscriber: means any person, company, partnership, organisation or body which ProtectMyWork.com supplies services to or browses www.protectmywor.com.

Work: "Work" refers to the registered work (digital files and data) that a member uploads or emails to their online account and can access in the "My Work" page within the members area, after logging in.

1. Conditions of Supply of Service:



Data upload, Retention and storage:

1.1. The user permits ProtectMyWork.com, to store their work for the agreed term. On expiry of that term (i.e. without renewal of subscription payment), the user authorises Protect My Work Limited, to delete all work files, personal data, copies of emails and digital certificates from the Protect My Work web server by the erasure of the users entire online account (See: "2. GDPR UK" below).

1.2. Before erasure of a user's account the user will receive three automated emails when a subscription renewal fails. The first two will inform the user that their subscription renewal has failed and offer the user a chance to renew. The last email our automated system will send is 30 days after expiry of the users account, which is our third and final email, warning the user that their account and data is going to be deleted, also including a list of all work/certificates that Protect My Work holds in the users online account and clear instructions on how to renew your account before erasure.

1.3. The maximum amount of data allowed per email (or per upload via online account) is 100 megabytes, which includes the mail message file itself if sent by email.

1.4. ProtectMywork.com will take reasonable steps to protect and store your files safely and securely but in the case of user error, failure to follow our rules as outlined in these terms and conditions or user software bugs or technical issues on their own device, we take no responsibility for corruption or loss of files or registration records. The user should ensure that they have an up-to-date web browser with cookies and JavaScript enabled as well as appropriate antivirus and firewall software.

1.5. Protect My Work backs up the website and data at regular intervals.

2. UK GDPR:

2.1. In order to comply with Article 5(1) and 5(2) of UK GDPR, Protect My Work ensures that we do not keep users data for longer than is necessary (i.e. we delete user's data if the user does not pay the annual subscription payment).

This ensures compliance with recital 39, specifically "ensuring that the period for which personal data is stored is limited to a strict minimum" and that time limits are established by Protect My Work for erasure.

To further comply with Article 5(2), Protect My Work is able to demonstrate compliance with paragraph 1 ("accountability") with our policy being clearly laid out in these terms and conditions as well as three automated emails upon a subscription renewal failure with the third and final email of said email string, listing all work held by Protect My Work for that user in their online account with a clear warning the account will be deleted due non-payment of the annual subscription fee.

3. Site and service usage:

3.1. The maximum number of attachments per email (or upload via online account) is 5.

3.2. ProtectMyWork.com reserves the right to change these terms and conditions of service.

3.3. ProtectMyWork.com will take all reasonable steps to ensure that website down time is kept to a minimum.

3.4. Subscribers with an active subscription may use our 'copyright protection warning' logos on their registered work.

4. Copyright

4.1. Copyright ProtectMywork.com does not claim to provide any formal legal/statutory protection or copyright registration, nor does it guarantee that the user owns the copyright for the material they upload. Our service helps our users provide evidence of originality and help prove the time and date of creation by an independent, third-party witness.

4.2. By using the service, the user attests:

- to being the creator and original author of the work or current copyright owner and is solely responsible for its originality, authenticity and safe-keeping.
- that the material does not infringe in anyway whatsoever any third-party copyright claims and thus indemnifies ProtectMywork.com from any such claims.

5. Confidentiality & non-disclosure

5.1. ProtectMyWork.com will keep subscribers' data safe and never disclose the contents of work submissions to third parties. Website work submissions are 100% processed and recorded by our secure server automatically, no member of staff looks at the content of work submitted.

The only exceptions to this is if it is deemed necessary by a director of ProtectMyWork.com to view the work in order to ensure it complies with the law, to investigate a breach of the law (e.g. breach of copyright or trademark), abuse of the system or staff or if the user specifically requests it. All passwords are securely encrypted in our database ensuring only the user has access.

6. 14 day money back period

6.1. The 14-day money back offer only relates to new subscribers. ProtectMyWork.com will provide refunds to the user for a subscription payment if we are notified in writing by email to support@protectmywork.com within 14 days of the initial subscription payment. The refund will be processed within 7 days (max) on receipt of that email. The 14-day money back offer does not apply to users that have previously subscribed to our service, or any other products or service provided.

7. Cooling-Off Period

7.1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you are entitled to a statutory cooling-off period of 14 days, which begins the day after you sign up for an account at www.protectmywork.com

8. Abuse

8.1. To uphold the safety of staff and the reputation of the company, the company may suspend or delete a user's certificate(s) and/or account(s) without notice, refund or compensation to the user, if the user is found to be breach of these terms, or specifically in the following serious situations:

- If the user's actions or uploaded content is deemed in breach of Law (intellectual property law or other laws), or in the opinion of the directors it can damage the reputation of the company or any of its other users.

- If the user is deemed to be abusing staff members (written or verbal).

9. Affidavit

9.1 In the event of court action, the user is allowed one free affidavit. The user will need to supply ProtectMyWork.com with a copy of their personal ID (e.g. passport), a copy of the court case hearing documentation which shows a valid case number, date of hearing, court name and address, claimant and defendant names and addresses. A request for an affidavit for court action cannot be made within the 14-day money back period.

10. Legal:

10.1. These Terms shall be governed by, and construed in accordance with, English law. The parties irrevocably agree that the courts of England shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute, which may arise out of, under, or in connection with these Terms or the relationship established by them.

10.2. ProtectMyWork.com does not allow any of the following content to be stored on its servers:

- Illegal Material,
- Adult Material (Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of ProtectMyWork.com)
- Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above.

11. Delivery of Subscription Service

11.1. The user can start using the service immediately upon payment approval. The service is delivered digitally. Annual subscription fees will be automatically collected every year in advance on the annual renewal date, unless the user cancels their annual subscription renewal payment before this date. Our FAQ explains how to cancel automatic subscription renewal payments within a user's online account.

12. Certificate Tokens

12.1. Tokens are bought by a user in order to upload a group of files to be date stamped and a digital certificate generated. Once a token has been used and a digital certificate generated, the certificate will have a unique reference number and a password will be created by our system in order to access only that digital certificate in cases where the certificate needs to be shared.

In addition, the user may click the "SHARE" button from within the users online account, on the "My Work" page, which will create a temporary hyperlink allowing the user to share the digital certificate without the need for a password.

Files cannot be edited or altered after they are uploaded, as this would invalidate our certification date stamp. Work can be deleted by the user but the token is not refunded. All certificates are kept in digital format for the duration of your subscription.

13. Force Majeure

13.1. Neither the user nor ProtectMyWork.com shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, the act or omission of government, highway authorities or any telecommunications carrier, operator or administration or other competent authority, the act or omission of any Internet Service Provider, or the delay or failure in manufacture, production, or supply by third parties of equipment or services, and the party shall be entitled to a reasonable extension of its obligations after notifying the other party of the nature and extent of such events.

14. Taxes & duties

14.1. Users outside the UK are responsible for paying any local taxes due in their country of residence.
